These Terms of Service ("Terms") govern your access to and use of BIMBAS (the "Service"), operated by KLYTICS LLC ("KLYTICS", "we", "us", "our"), a limited liability company organized under the laws of the Commonwealth of Puerto Rico. By creating an account or otherwise using the Service, you ("you", "user", "creator") agree to be bound by these Terms.
BIMBAS is a trend intelligence platform that ingests public social media signals, produces machine-scored virality forecasts, and generates AI-assisted content briefs for creators in specific niches. The Service additionally tracks the realized performance of creator-submitted videos against its predictions to provide a calibration feedback loop.
You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. By using the Service you represent that you meet this requirement and that your use does not violate any applicable law.
Account creation and authentication are handled by our identity provider, Clerk. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly at support@bimbas.io of any unauthorized use.
Paid plans are billed through Stripe. By starting a paid subscription you authorize us, via Stripe, to charge the payment method on file for the recurring subscription fee until you cancel. Cancellation takes effect at the end of the then-current billing period; no partial refunds are issued for unused time except where required by law.
You retain ownership of all content you submit to the Service, including video URLs you voluntarily provide for performance tracking and any content briefs generated for you. By submitting such content, you grant KLYTICS a non-exclusive, worldwide, royalty-free license to process, store, and display the content solely to operate, maintain, and improve the Service.
Aggregated, de-identified performance metrics derived from user submissions may be used by KLYTICS for product calibration, benchmarking, and public reporting (e.g., the aggregate "BIMBAS Lift" statistic). Such aggregates will never identify individual users or their specific videos.
You agree not to:
The Service relies on third-party providers, including Clerk (authentication), Stripe (payments), Anthropic (AI inference for content briefs), Resend (transactional email), PostHog (product analytics), Sentry (error monitoring), and public video-metrics APIs from TikTok, YouTube, and Instagram. Your use of the Service is also subject to the terms of those providers where applicable; KLYTICS is not responsible for their acts or omissions.
The Service, including all software, visual design, trademarks, and documentation, is the property of KLYTICS LLC and is protected by intellectual property laws. Nothing in these Terms grants you any right in our trademarks or branding.
The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied. KLYTICS does not warrant that predictions, scores, briefs, or performance projections will be accurate, complete, or free from error. Content decisions and their outcomes remain your responsibility.
To the maximum extent permitted by applicable law, KLYTICS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Service. Our aggregate liability for any claim arising out of these Terms shall not exceed the greater of (a) the fees you paid to KLYTICS in the twelve months preceding the claim, or (b) fifty U.S. dollars ($50).
You agree to indemnify and hold harmless KLYTICS and its officers, employees, and agents from any claim or demand, including reasonable attorneys' fees, arising out of your breach of these Terms, your violation of any law or the rights of a third party, or your misuse of the Service.
You may terminate your account at any time through the in-app settings or by contacting us. We may suspend or terminate your access to the Service immediately, with or without notice, for any breach of these Terms. Sections 5 (second paragraph), 8, 9, 10, and 11 survive termination.
These Terms are governed by the laws of the Commonwealth of Puerto Rico, without regard to its conflict-of-laws rules. Any action arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in San Juan, Puerto Rico, and you consent to the personal jurisdiction of those courts.
We may update these Terms from time to time. Material changes will be communicated by email or in-product notice at least seven (7) days before taking effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
